This nomination of Sotomayor is an opportunity for conservatives to marshall a serious attack on the left wing agenda. Not through personal attacks, but through a serious challenge to her thinking on what a court should do. The justice is blind and the role of the court system in the United States must be discussed, and argued. We must not allow the legislative role be "subordinated to" the role of the Judiciary. The judiciary is the arbiter, not the legislature.
It is my view that this judge carries the conviction that it is the court's role to "set policy." She said it in a lighthearted moment, off guard and vulnerable. The plain fact is, most of the judges on the left end of the political spectrum, believe that is their role to make judgments about society norms that the "common man" cannot make. I do not think that conservative voices should be shrill and vicious, but I do believe that there must be a vigorous review evaluation and, if appropriate, opposition to her candidacy. This empathy factor is not what I believe that judges should have; they should know the law, and evaluate the application of the law to the real world; objectively, impartially and in complete respect of the constitution.
I want to know more about her beliefs about the right to arms; the concern about the role of affirmative action on promotions; the views about how her sex or ethnicity has an impact on her decisions. I may be overreacting, and it is possible that I could actually get on board with her as a reasonable example of a "liberal judge" who can be generally balanced. If so, I will get on board later; but I am not ready to roll over and ignore warning signs.
